By accessing or using WA Tracking ("the Service") at watracking.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all users, including visitors, customers, and those with free accounts.
WA Tracking is a SaaS (Software as a Service) platform that enables Google Ads professionals to track which keywords, campaigns, and ad clicks drive WhatsApp button contacts on their clients' websites. The Service captures Google Click IDs (GCLIDs), keywords, and click metadata via a Google Tag Manager snippet, and presents this data in a dashboard with CSV export functionality.
All payments are processed by Lemon Squeezy, our Merchant of Record. Lemon Squeezy handles all payment processing, tax collection, and compliance with applicable financial regulations on our behalf. By making a purchase, you also agree to Lemon Squeezy's Terms of Service.

The Service is offered on a monthly subscription basis. The following plans are available:
Subscriptions are billed monthly in advance. Your subscription automatically renews at the end of each billing period unless cancelled before the renewal date.
Prices are displayed in US Dollars (USD) and may be subject to applicable taxes determined by Lemon Squeezy based on your location.
A free account is automatically created when you first sign in. Free accounts are limited to 1 domain and 50 WhatsApp click events per month. Events exceeding this limit will be silently dropped. WhatsApp buttons on your website will continue to function normally, but excess events will not be recorded in your dashboard.
You may cancel your subscription at any time. Upon cancellation:

You may only install the WA Tracking GTM snippet on domains you own or have explicit authorization to manage. You agree not to:
You retain ownership of all data collected through your account. We process this data solely to provide the Service as described in our Privacy Policy. You are responsible for ensuring you have the appropriate legal basis to collect click attribution data from your website visitors under applicable laws (including applicable privacy laws in your region).
We target 99.9% monthly uptime but do not provide a guaranteed SLA on paid plans. We use commercially reasonable efforts to maintain service availability. Planned maintenance will be communicated in advance where possible.
The GTM snippet is designed to fail silently. If the Service is unavailable, WhatsApp buttons on your website will continue to function normally; events simply will not be recorded during the outage.
The Service, including its software, design, and documentation, is owned by WA Tracking and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose during your subscription period.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:
To the maximum extent permitted by applicable law, WA Tracking shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.
Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount paid by you to WA Tracking in the three months preceding the claim.
You agree to indemnify, defend, and hold harmless WA Tracking and its officers, employees, and agents from any claims, liabilities, damages, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.
We may suspend or terminate your account without notice if you violate these Terms or engage in any activity that we reasonably believe is harmful to the Service or other users. You may terminate your account at any time by cancelling your subscription and contacting us to request account deletion.
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms shall first be attempted to be resolved by good-faith negotiation. If a dispute cannot be resolved informally, it shall be subject to binding arbitration or the courts of the applicable jurisdiction.
We reserve the right to update these Terms at any time. We will notify active subscribers by email at least 7 days before material changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
